The new bankruptcy laws and you

A lot of people do not understand how the new bankruptcy laws impact them. We have clients come into our office who do not even realize that Chapter 7 bankruptcies still exist. The reality is, they do, and in most cases Chapter 7 is available to an individual seeking bankruptcy protection. The biggest change the law puts into place is "means testing" to determine if the median income of a family is above a certain threshold. If the filing party's median income is less than the median, typically it is not a problem to file a Chapter 7 bankruptcy. If it is more than the median, the court will require the client to provide information about their incomes, debts and assets in order to determine if they are eligible to file. Even with this requirement, there is still a good chance of being able to file a Chapter 7 bankruptcy.

As of December 2006, the following were the median incomes for families of sizes one to six individual:

  • Family of one - $41,263
  • Family of two - $49,080
  • Family of three - $59,142
  • Family of four - $71,542
  • Family of five - $77,842
  • Family of six - $84,142
