Approved Credit Counseling is Required for Bankruptcy

The new bankruptcy laws include two major components: required means testing and required credit counseling. The means test is administered by a qualified bankruptcy attorney and determines whether families are eligible to file for Chapter 7 or for Chapter 13.The required credit counseling goes beyond the run-of-the-mill agencies that prolong the inevitable through debt consolidation or lowered interest rates.

Under the new laws, people considering bankruptcy must meet with an approved national credit counseling agency prior to filing. When the bankruptcy law firm has received a copy of the certificate of completion for the counseling, then the attorney may proceed with filing. Post filing, debtors must complete an additional counseling requirement covering topics such as responsible borrowing, budgeting and improving credit reports.
