Stopping repossession

Filing bankruptcy backs creditors off completely. By filing for Chapter 7 bankruptcy, a client gets to determine what property they would like to keep and that which they want to get rid of. If wages are being garnished, that too will stop. Even if a client has already had property taken, it can be reclaimed, as all property is part of the bankruptcy estate and thus rightfully belongs to the client.

Trying to get caught up on a mortgage without Chapter 13 bankruptcy protection is nearly impossible, and can lead to a bank foreclosing on the home. A bank will only stop the foreclosure process if payments are up to date and current. A main reason people file for bankruptcy is to save their home. If they are behind on their mortgage, filing a Chapter 13 bankruptcy will reorganize the mortgage and prevent the home from being foreclosed on by giving the homeowner an opportunity to catch up over a three to five year period rather then having to pay it all right now.
